The offering of a financial advantage in exchange for the resignation of a seat
in parliament
1) Is there any legislation or other form of regulation, such as a code of conduct, that
prohibits:
i. a Member of Parliament from accepting a financial advantage on the condition that
they resign their seat;
ii.
the act of offering such a proposal, including by individuals from the member’s
own party.

Constitution of the Republic of Slovenia in Article 82 provides:
(1) Deputies of the National Assembly are representatives of all the people and shall not be bound by any
instructions.
(2) The law shall establish who may not be elected a deputy, and the incompatibility of the office of deputy
with other offices and activities«
The Constitution thus gives MPs autonomy, which means that they are not bound by any
instructions, including party instructions. They are obliged to exercise their mandate in
accordance with the Constitution, the law and the Rules of Procedure of the National
Assembly. A Member of the National Assembly may not hold any office or engage in any
activity that is incompatible with the office of a Member of the National Assembly under the
law. Otherwise, the right to immunity is guaranteed by the Constitution.
